Afronesia Tours is the ‘Operator’. Your agreement is with Afronesia Tours and a contract will come into existence between us when you make a reservation with us.
The invalidity of the provisions hereof shall not affect the validity of any of the other provisions, and the agreement shall be construed as though such invalid provision had never been contained herein.
Disclaimer: Travel is personal and each individual’s goals and experiences may differ. Afronesia Tours will not be bound by, or liable for, any description, representation or warranty made by any supplier, or other person or entity relating to any holiday offered by Afronesia Tours.
Departure date: The departure date constitutes the indicated on the Afronesia Tours confirmation.

Inter-city travel: By private mini-bus and fast boat (see itinerary).
Air Transportation: All internal flights in Indonesia are included in the price as per the itinerary. All flights are subject to availability.
Touring: Afronesia Tours’ mini-busses feature air-conditioning and are configured with 18 seats for the tour maximum of 12 guests, excluding 1 Tour Director and driver. The vehicles will be adjusted for smaller or bigger group.
Hotel Accommodation: Prices are per person and based on two persons sharing a double/queen/king or twin-bedded room with private bath or shower.
Substitute hotels may sometimes be used at certain times and will be of similar standard whenever possible. Special room requests such as smoking/non-smoking, adjacent, connecting or lower-floor rooms must be requested at time of booking. These special requests cannot be guaranteed and are based on availability at time of check-in. Smoking in a non-smoking room may result in a fine. Hotel Frequent Traveller programme points are not earned with hotels on Afronesia Tours' vacations.
Tour Directors: Afronesia Tours are concluded in English by professional multi-lingual Tour Directors fluent in English and Bahasa Indonesia.
Meals: Meals are included as detailed on itineraries.
Any special meal requirements will be made on a REQUEST basis only and must be advised at the time of booking. Afronesia Tours cannot guarantee special meal requests, nor will Afronesia Tours assume any responsibility or liability if guest’s special meal requests are not fulfilled.
• No refunds are issued for missed meals due to late arrival.
Sightseeing: Excursions, entrance fees and English-speaking guide (when required) are included as detailed in the itinerary.
Premium Highlights: Featured sightseeing as per the itinerary is integrated to our Tours, therefore no refund will be given (or value attached) if not used or operated for any reason.
Transfers: Between airports, hotels and piers are included as indicated on the itinerary. All transfers are based on group shuttle. No refund is therefore available for missed or unused transfers. In the event of flight delays outside of Afronesia Tours’ control, the transfer will be deemed to be cancelled. Afronesia Tours is not responsible for delayed or cancelled transfers due to unforeseen events.
Porterage: Due to limited mini-bus capacity, a single bag should have dimensions not exceeding 77.5x56x32cm and weight not exceeding 30kg. Please note that some airlines restrict checked luggage allowance – we will advise you upon booking your flight. Any excess baggage costs will be for your own account. Do note that some airlines charge up to US$60 per kilogram. Carry-on/hand luggage is restricted to one piece per person, not exceeding 30x28x12cm. Carry on/hand luggage handling is the responsibility of each guest and must be taken on and off the mini-bus by you each day.
Afronesia Tours and Afronesia Tours’ affiliated entities shall not be liable for any loss or damage to baggage or any of the guest’s belongings. Guests should report any lost items to the Tour Directors who will assist in completing a lost property form that can be used for any insurance claim in this matter. However, Afronesia Tours cannot assist in locating any lost items once the Guest disembarked or completed the Tour as the case may be.
Afronesia Tours is not responsible for additional fees imposed by air carriers regarding baggage.
Free Wi-fi Internet Service: Complimentary Wi-fi service is available in many Afronesia Tours’ hotel guestrooms. When such service is not available complimentary Wi-fi will be available in the public areas of most hotels.

International flights: All international flights are not included and can be arranged separately. Any items and matters referred to above, including, all airfares and air-related charges between your getaway city and your destination, additional fees charged by airlines such as checked and/or excess baggage, seat selections and any other services; passport and visa fees; insurances of all kinds; tips/gratuities to mini-bus Drivers and Local Guides; laundry, phone calls; internet access; minibar; beverages and meals not detailed in the itinerary; Optional Experiences; and all items of a personal nature. Additional taxes and surcharges may be collected by foreign governmental and non-governmental entities. The price does not cover costs and expenses, including your return home, if you leave the Tour whether at your own volition, due to illness, action by any government or other reason. This list is illustrative and not a complete list of every item not included.
Tips/Gratuities: All tips for services on Tours provided by drivers, tour guides (where applicable), dining-room waiters, chambermaids and porters at hotels, airports and docks.

The costs associated with travel arrangements are not always stable and currency movements can fluctuate sharply. It is impossible to predict these movements in advance. When you book a package through Afronesia Tours, we reserve to the right to pass on any surcharges to you. Surcharges may be imposed to cover increases in transportation costs, including the costs of the fuel and security charges, taxes or fees chargeable such as landing taxes or embarkation or disembarkation fees at ports and airports, or exchange rates applied to the particular package.
Should a Guest make a group reservation and subsequently the group number deviate from the minimum required for the booking, Afronesia Tours reserves the right to re-cost and raise the surcharge. Should any Guest refuse to accept and pay such surcharge, it may result in cancellation of the booking and forfeiture of all payments made.
Afronesia Tours guarantees the price of land arrangements, only once full payment is received.

A non-refundable deposit of R 2 500 is payable within 48hrs after booking.
• Full airfare to be paid before issuing the tickets.
• Final payment 60 days prior to departure date.
1. Your Tour will be confirmed by Afronesia Tours after receipt of a non-refundable, non-transferable deposit. We reserve the right to refuse a booking without giving any reason. The deposit forms part of your final payment. If not received within 48hrs of booking, the reservation will automatically be cancelled. On certain departures, deposit may be required at time of booking to hold seats.
2. Final payment for your land reservation will be due no later than 60 days prior to the tour departure date.
3. Payment in full will be required at time of booking for reservations made less than 60 days prior to the tour departure date.
4. Afronesia Tours reserves the right to cancel the reservation and impose cancellation charges if any payment is not received within the above specified periods. Afronesia Tours will not be responsible for lost land and air reservations.
Forms of Payment: Afronesia Tours shall hold all the monies for each and every person named in the booking until the booking is confirmed. You consent to us depositing monies received by us as required by law. We will be entitled to keep interest earned on monies. You consent that all monies paid to us whether by deposit or otherwise, may be disbursed by as and when we see fit.
The only acceptable forms of payment are:
1. Direct cash deposits. The payment must reflect in Afronesia Tours’ bank account before the Supplier is paid.
2. Electronic Funds Transfer (EFT).
Proof of all cash deposits and EFT’s must be e-mailed or faxed to Afronesia Tours.
Passports: Afronesia Tours will not be responsible for advising and/or obtaining required travel documents for any Guests, or for any delays, damages, and/or losses including missed portions of your vacation related to improper documentation. Due to government imposed security/immigration measures, passport and emergency contact information is required for all Guests prior to release of travel documents.
It is entirely the Guest’s duty to ensure that all passports are current and will be valid for at least six months after the clients return to his/her home country. It is strongly recommended that copies of the passports are given to Afronesia Tours at the time of the booking to ensure that all names are spelt correctly.
Non South African passport holders are required to have a minimum of three blank pages – excluding the front and back covers - in their passport for the entry visa. If there is insufficient space in the passport entry will be denied and person is likely to be detained pending return to their country of origin.
Non South African passport holders may also be required to have re-entry documentation and it is entirely the Guest’s duty to ensure that such documentation is in order before departure.
Driver's Licence: Should the Guest be driving overseas they must obtain an International Drivers Licence in their country of residence prior to their departure. The Guest must also take their National Drivers Licence with them as proof.
Visas and Health: A visa will be issued to South African passports holders on arrival at major airports in Indonesia, provided that all passport requirements and government regulations have been met. It is entirely the Guest’s duty to ensure that all visas excluding the Visa on Arrival are obtained on time and that the correct number of entries on the visa is noted. It is the clients duty to ensure that any vaccinations, inoculations, prophylactic (e.g. for malaria) and the like, where required, have been obtained.
It is the Guest’s duty to familiarise him/herself with the inherent dangers of and mental and/or physical condition required for the Proposed Travel Arrangements.
Afronesia Tours cannot accept any responsibility for the issuing or non-issuing of the Visa on Arrival.

Travel arrangements for any member of the party may be cancelled at any time by written notice by the person who made the booking. Please note the following:
• If notice of cancellation is received by Afronesia Tours at any time after booking confirmation, the non-refundable deposit will be retained.
• If full payment is not received 60 days prior to departure date, Afronesia Tours has the right to cancel your reservation. Afronesia Tours will not be responsible for lost reservations.
• Notice of cancellation must be made in writing directly to Afronesia Tours.
• If a person in a party cancels and there is a room charge caused by this cancellation (such as a Twin to Single), charges for the upgrade will be the responsibility of the remaining party.
The following charges may apply when notice of cancellation is given after the booking is confirmed:

• If a Guest fails to join the tour on the day of departure, cancellation fees will be 100% (unless the Guest notifies us of the delay and joins the tour later at their expense).
Airline/Flight Tickets: After deposit has been received, any change incurs a R250 service fee per person PLUS any additional change/cancellation fees imposed by the Airline. Some airfares including published fares booked by Afronesia Tours are non-changeable or non-refundable.
• Afronesia Tours is not responsible for other travel arrangements that you or your party has made outside Afronesia Tours and which are affected by our cancellations.
If the reason for your cancellations is covered under your insurance, you may be able to reclaim these charges from your insurer. You are responsible to make the claim to your insurer.
Illness and Absence: Early departure expenses are the guests’ responsibility, there is no refund for absence or early departure from a tour, including but not limited to missed hotels, transfers, meals or sightseeing. Afronesia Tours urges you to purchase travel insurance to cover such circumstances. Afronesia Tours makes no representation or guarantees concerning reimbursement, scope of coverage, or other aspects of any travel insurance policy or claim.

Reservation/Ticketing: Before Afronesia Tours can proceed to book any flights, full payment is required. Upon receipt of air payment your airfare, taxes and fuel surcharge are final. This will be regardless of future price fluctuations up and down.
You will be required, at the time of booking to provide us the full name as detailed on the passport or government-issued ID for domestic travel, passport number, date and place of issue for each guest.
Changes to flight itineraries and name changes may result in penalties charged by the airline. These are Guests’ responsibility. All airfares and routings are subject to change at any time until full payment is received and air tickets are issued.
Air Cancellations: Non-refundable tickets cannot be refunded. Airlines may impose penalties up to 100% of the air ticket value.
Airline Availability: Seats are limited in our contracted class of service and may not be available in every flight. Afronesia Tours does not hold block space on any airline and does not assure seat availability for every single Tour departure date.
Airline Seating: Not all airlines offer pre-assigned seats. Some may charge for pre-assigned seats. Any additional charge imposed by airlines will be at the Guests’ expense. Where pre-assigned seats are not offered or different seats are desired, Guests must contact airline(s) directly to arrange seating assignments. Seating is solely under the airline’s control, as are itinerary changes due to flight delays and schedule changes. Afronesia Tours reserves the right to offer alternative schedules for itineraries affected by airline schedule changes and equipment. Flight delays, flight cancellations and schedule changes are the responsibility of the airlines. Afronesia Tours will not be responsible of liable for such delays or rescheduling.
Price Changes: Airlines and other travel providers (including Afronesia Tours) change pricing and itineraries from time to time. Prior to your booking and paying for travel, all prices and itineraries on our Tours are subject to change at any time.
Guest Changes: Changes to flight itineraries and names may result in penalties charged by the airline. These are the Guests’ responsibility.
Airline Special Request: Seat assignment and any special meal requests can be requested at time of booking. Afronesia Tours does not assure the request will be granted. Frequent Flyer miles can be accrued on most air carriers. Upgrades using mileage is not permitted. Many airlines do not automatically add Frequent Flyer numbers to records for flights booked and ticketed by Afronesia Tours. It is therefore the Guests’ responsibility to request Frequent Flyer credit from the airline. Afronesia Tours will not be responsible for matters occurring Frequent Flyer miles.

Tour Price: Are based on costs, charges, tariffs, rates, prices, taxes, levies, exchange rates and other considerations as of the production date of this Tour. All are subject to change. No surcharges regarding cost or currency fluctuations will be made to the LAND only price once the full payment is received. However, airport taxes, fuel surcharges and taxes, charges and levies imposed by a government, airlines or agencies may be passed on at any time, even after the deposit is received. All prices are in US Dollar unless specified.
Participation: On all Tours children under 10 years of age are not eligible to travel. Children under 18 years of age must be accompanied by an adult, who will be responsible for their welfare and supervision. Afronesia Tours seeks to provide a safe, enjoyable and memorable travel experience for all guests. Regrettably all Tours offered by Afronesia Tours are not suitable for Guests with special needs and disabilities. Please note the following:
• Guests must advise Afronesia Tours, in advance, as early as possible, of any medical needs. Afronesia Tours will make reasonable modifications of its policies, practices and procedures when necessary, unless doing so will fundamentally alter the nature of services provided.
• Guests must ensure they are medically and physically able to travel.
Afronesia Tours does not employ medical personnel. Any necessary medical attention must be sought at a local facility, if available, at guests’ expense. Afronesia Tours is not responsible or liable for losses or costs incurred due to unavailability of medical services, or medical services obtained while on vacation, or for the quality of the care and services received.
Many Optional Experiences are available and operated by independent third party suppliers, not Afronesia Tours. These are not part of the Tour provided by us. Your contract will be with the operator of the excursion. We are not responsible for providing the excursion, or anything that happens during the excursion. Some excursions involve outdoor activities and/or can be physically demanding. You must make your own decisions about the excursions and participate only in activities that suit your physical ability. We recommend you check whether any insurance you have also includes your participation in adventure activities you may undertake.
Afronesia Tours may, in sole discretion, decline booking any guest or remove any Guest who cannot comply or refuses to comply with Afronesia Tours’ terms and conditions.
Behaviour: We are here to provide the best services possible but in doing so we will not tolerate abusive and aggressive behaviour of our Guests. We will refuse to deal with and may terminate the holiday/vacation of people who assault Afronesia Tours’ Representatives or who continue to be verbally abusive or aggressive when asked to behave reasonably.
When you make a booking you accept responsibility for the proper conduct of all members of your party during your stay. We reserve the right at any time to terminate the travel arrangements and/or cease to deal with any party member(s) whose behaviour, in the reasonable opinion of us or our suppliers, may cause danger, upset, disruption or distress to anyone else or damage the property. Full cancellations charge will apply and no refund will be made. We shall have no obligation to pay compensation or meet any costs or expenses (including but limited to alternative accommodation and return transportation arrangements) the Guest may incur as a result of the travel arrangements being terminated.
If you damage the accommodation in which you are staying or any property, you must reimburse the accommodation provider or property owner concerned for the cost of the damage before the end of your stay if the cost has been established by then or as soon as it has been established. You must indemnify us for the full amount of any claim (also including legal cost) made against us. Criminal proceedings may be investigated. Afronesia Tours is not responsible for any costs incurred concerning a guest removed from a tour or aircraft, ship or train. Guests agree not to hold Afronesia Tours or any of its related entities liable for any actions taken under these terms and conditions.
Itinerary Variations: Afronesia Tours strives to improve itineraries, services and features. If improvements can be made, or if circumstances beyond our control make changes necessary, we reserve to vary itineraries and to substitute hotels. Certain activities may not be precisely as described or may not be available due to seasonality or weather conditions. We will try to notify you of changes. If your enjoyment may be diminished by such limitations, please check with us before making a reservation.
In the unlikely event of there being unscheduled change to the final itinerary caused by flight re-scheduling and delays, bad weather, strikes or any other cause which is beyond the control of Afronesia Tours, or its Suppliers, it is understood that any expenses relating to these unscheduled changes (hotel accommodation etc.) will be for the Guests’ account.
Extended Stays: Afronesia Tours does not offer any extended stay options on our Tours. Neither pre- nor post-night accommodation nor transfers.
For Your Comfort: Afronesia Tours enforces a strict no smoking and no alcohol policy on board mini-busses.
Tour Cancellations: Afronesia Tours reserves the right to cancel or re-schedule any Tour departure at any circumstances, including in accordance with operating requirements or circumstances beyond its control.
Travel Insurance: Afronesia Tours recommends that all guests purchase comprehensive Travel Insurance. Certain countries have a requirement for foreign visitors to have valid medical insurance on entry. Afronesia Tours cannot be held responsible for denied entry if Guests are unable to provide details to authorities of insurance or denial of entry for any reason.
Afronesia Tours can assist the guest in obtaining Travel Insurance as laid out in Section 22 of the Tourism Act of 1993. Insurance can only be purchased prior to departure and Afronesia Tours strongly advise that all Guests take out adequate insurance cover. Assistance for this insurance is available on request. Afronesia Tours will not be responsible or liable if the Guest fails to take adequate insurance cover or at all.
It shall not be obligatory upon Afronesia Tours to effect insurance for the Guest except upon instructions given in writing and all insurance effected by Afronesia Tours pursuant to such instruction will be subject to such exceptions and conditions as may be imposed by the insurance company or underwriters accepting the risk, and Afronesia Tours shall not be obliged to obtain separate cover for any risks so excluded. Once the insurance has been confirmed and paid for, the guest will be issued with a policy document of the insurer. It is a complex document, which must be read BEFORE YOU initiate your travel so that you can address any queries you may have to the insurer PRIOR to your departure.
Should the insurers dispute their liability for any reason, the Guest will have recourse against the insurers only, and Afronesia Tours will not be under any liability whatsoever.
Some credit card companies offer limited levels of travel insurance, which Afronesia Tours do not consider sufficient cover for international travel. Afronesia Tours recommends that you check with the respective credit card companies whose card you will be paying with in order to obtain the specific details of their cover.
Disclaimer of Warranties: The Operator warrants only that the services shall be generally, though in view of the vagaries of travel, not necessarily precisely, as described, and subject to changes and the other terms and conditions herein. All other warranties, express and implied, including warranties of fitness for a specific purpose and merchantability are expressly excluded. There is no warranty that extends beyond the description of the face hereof.

Complete Agreement: These booking conditions together with terms expressly incorporated into this contract represent the entire agreement between the parties.
Changes: The Operator shall be responsible to the Guests for supplying services and accommodation described in this itinerary, except where they cannot be supplied or the itinerary is changed due to delays or other causes of whatever kind or nature beyond the Operator’s control. In such circumstances, the Operator will seek to supply comparable services, accommodation and itineraries and there shall be no refunds in these circumstances.
Disclaimer of Liability: Neither the Operator nor its agents or affiliated entities shall be responsible or liable for cancellations, acts of other service providers, diversions or substitution of equipment or any act, variation, postponement, omission or default by air carriers, land carriers, hoteliers or hotels, transportation companies, or any other person providing services or accommodation to guests including any result thereof, such as damage to baggage or property, or for injury, illness or death, or for any damages or claims whatsoever arising from loss, negligence or delay from the act, error, omission default or negligence of any person not its direct employee or under its exclusive control, including any act, error, omission, default, or negligence of any country, government or governmental authority, officer or employee. Afronesia Tours shall not be liable for indirect, special or consequential damages. All baggage and personal effects are at all times and in all circumstances at the risk of the tour participant. Afronesia Tours recommends that Guests obtain baggage insurance. After return at the end of the tour, if lost articles are found and returned to the owner, a service fee will be charged. The carriers, hotels and other suppliers who provide services on the Tour are independent contractors; they are not agents, employees or servants of the Operator. All certificates and other travel documents for services issued by the Operator are subject to the terms and conditions specified by the carriers and suppliers and to the laws of the countries in which the services are supplied. The Operator is not responsible for any criminal or other conduct by third parties, whether criminal, intentional, grossly negligent, negligent or otherwise.
Security is a major concern to all of us and the situation globally is constantly changing. Events around the world, coupled with the “Travel Advisories” put out by various governments, may at these times necessitate changes to the accommodation and itinerary or even Tour cancellations. Please refer to our Terms and Conditions for further information in this regard. You must accept this risk involved in travel to any country that may experience security difficulties and accept responsibility for your own travel decisions.
Safety: Where the Guest occupies a mini-bus seat fitted with a safety belt, neither the Operator nor its agents or co-operating organisations or service providers will be liable for any injury, illness or death or for any loss or damages or claims whatsoever arising from any accident or incident, if the safety belt is not being worn at the time of such an accident or incident. This exclusion and limitation of liability shall not be used to imply that the Operator or its agents or affiliated entities are liable in other circumstances.
International Treaties: Transportation companies, airlines etc. are not to be held responsible for any act, omission or event during the time Guests are not on board planes, transportation or conveyances. We rely on international convention which may apply to the services provided by us or our suppliers with respect to any claim of any nature brought by you against us as a result of the provision of those services. International conventions which apply may include: Warsaw Convention 1929, (as amended by Hague Protocol and Montreal Protocol) on relation to air travel, or Montreal Convention; the Berne Convention for rail travel; Athens Convention 1974 for carriage by sea; the Geneva Convention for carriage by road and the Paris Convention 1962 for Hotels. We are to be regarded as having all the benefits of these conventions on limiting our liability in relation to any claim for death, injury, loss, damage and delay by the Guests and luggage. Enrollment in and payment for a Tour shall constitute agreement and acceptance by the Guest of the terms and conditions in this tour as stated. These cannot be varied except in writing by an office of the Company.
Errors and Omissions: In the case of computer or human billing errors, we reserve the right to re-invoice participants with correct billings.
We try to ensure information accuracy at the time of printing. However Afronesia Tours shall not be held responsible for printing or typography errors, or errors arising from unforeseen circumstances.
Airline(s) do not by virtue of being referred to in this information represent itself or themselves as contracting with or as having any legal relationship with any purchasers of a vacation from Afronesia Tours. All bookings made with any provider of transport, facilities, meals, other goods or of any services are subject to terms and conditions imposed by them in relation to matters not covered particularly and expressly by our agreement with the above mentioned Operator. If you decide you do not want to visit a country or part of the country you intended to visit due to any law, condition or requirement of any government or government authority, official, servant or supplier, you are responsible for any costs, expenses, charges, fees, losses or damage incurred, and any cancellation or amendment fees.

Complaint Procedure: If you have problem during your Tour please inform Afronesia Tours’ Tour Directors immediately, who will try to put things right. It is important that you provide us the information quickly. Failure to follow this procedure may delay or deny us the opportunity to investigate and rectify the problem, which may affect the way your complaint is dealt with and your rights under this contract.
Data Protection: To process your Tour booking, Afronesia Tours will need to use personal information for you and Guests in your booking. Personal information may include each guest’s name, address, phone number, email address, passport number, credit/debit card number and sensitive information such as health, medical, dietary, mobility, religious or other special requirements. This personal information may be passed onto other suppliers of your travel arrangements in addition to public authorities (such as customs and immigration), security and credit checking organisations, and otherwise as required by law. We may need to provide personal information to contractors who provide services to our Tour (e.g. sending mail, processing payments, providing marketing assistance). This may involve sending personal information (including sensitive information) to other countries that may not afford the same level of protection of personal information. In making your booking, you consent to your personal data being passed to relevant third parties as set out above.
We may also use the personal information you provide us to review and improve the Tours and services that we offer, and to contact you (by post, email and/or phone) about other offers by Afronesia Tours that you may be interested in. If you don’t want to receive this information or want a copy or the personal information we hold about you, write to us at Afronesia Tours, PO Box 840, Wellington, 7654, South Africa or send us an email at Afronesia Tours may charge a fee for shipping you with this information as permitted by law. The booking conditions set out herein are in compliance with existing legislation and regulations as the date of publication hereof. Should any further legislation and/or regulations be promulgated subsequent to the aforesaid date that may render any provision of the booking conditions and/or the performance thereof in contravention of the law, the relevant contravening provision/s shall be deemed to have been severed from the balance of the booking terms with immediate effect and without further notice to ensure compliance of the booking conditions with all new legislation.

Each Guest is required to comply with the terms, conditions, requirements, laws, rules and/or regulations of any service provider, or any country or governmental authority, and shall be liable for any such non-compliance.
Booking Arrangements: Your booking arrangements can be made directly with us. When you make a booking you must be at least 18 years of age at the time of booking. You are guaranteeing that you understand and have the authority to accept and do accept on behalf of yourself and all members of your party the terms of these booking conditions. We will deal only with the lead booking name in all subsequent correspondence and dealings, you are responsible for making all payments due, ensuring the accuracy of all personal details and other information supplied in respect of yourself and your party, notifying us of any changes or cancellations and for receiving correspondence and keeping your party informed.
